Daz Cox Trading Terms and Conditions By continuing the act of trading, the seller, purchaser of Daz Cox’s services hereby known as “The Customer”, agrees in whole and completely, with full understanding, with the following terms and conditions. A. Process 1. Sale Preparation Period The standard preparation period is a minimum of 4–6 weeks, and is part of what is required for preparation, as part of the sale process. This may be extended due to circumstances outside our control (e.g., weather events, show commitments). In such cases, only agistment fees ($110/week) will be charged for any additional time, as a result of the above mentioned “circumstances out of our control”. Once the preparation period is completed, and/or the additional period required to “prepare” the horse, then agistment is charged until the horse is sold. 2. Commission Structure A standard commission of 10% (plus GST) of the final sale price applies to all horses sold through Daz Cox. If the horse is sold by the customer or a third party whilst in our care, ( or outside the ‘cool off period’ )the agreed commission and fees are still payable. 3. Assessment Rides & Additional Training Following the first one or two assessment rides, if the horse is deemed to require additional training to be sale-ready, Daz Cox will contact the customer to discuss options, timeframes, and any associated costs before proceeding. 4. Confidentiality If a buyer requests confidentiality regarding the sale, the customer must agree to these terms. 5. Sale Restrictions If there are specific restrictions on where a horse may be sold (e.g., for skin conditions), these must be clearly stated in the booking form. 6. Payment Process Once a sale is agreed, payment will be made by the buyer directly to Daz Cox. Funds will then be transferred to the customer, with commission and agreed expenses deducted. A full tax invoice will be issued, by Daz Cox for all services and charges. B. Care 1. Routine Care Requirements All horses must be up to date with farrier work, dental care, and worming prior to arrival. Before the horse leaves for its new home, Daz Cox will arrange these services to be updated, and the customer will be invoiced accordingly. Dental work is considered current if completed within the last six months, with veterinary or dental records provided. 2. Vet Checks & Disclosures Pre-purchase veterinary examinations are welcomed. The customer must disclose any known injuries, illnesses, or conditions in the booking form. 3. Injury, Veterinary Care & Insurance Whilst all reasonable precautions are taken to minimise risk, horses are kept, trained, and presented at the customer’s risk. Should injury, illness, or other health concerns arise, the customer is responsible for all associated veterinary fees. We strongly recommend that customers maintain appropriate insurance coverage for loss, injury, or illness during the horse’s stay. ⸻ C. Conditions 1. Agistment & Training Fees All agistment, commission, and training fees are payable as per the agreed rate after the sale is complete. 2. Termination of Agreement Daz Cox reserves the right to terminate the agreement at any time if the horse is deemed unsuitable for sale due to behaviour, health, or other concerns. In such cases, the horse must be collected by the customer, with all fees paid in full before release. Where an agreement is terminated by either party, then agistment will be applicable, up to the point of departure. 3. Exclusive Sale Rights Once a horse is booked in for sale with Daz Cox, all marketing and sale activities must be conducted exclusively by Daz Cox. The owner must not independently advertise or sell the horse during the agreed preparation and marketing period. 4. Media Ownership All photographs, videos, and marketing materials produced by Daz Cox remain the property and copyright of Daz Cox. They may not be used, reproduced, or supplied to third parties without prior written consent. 5. Cooling Off Period The customer has the right to change their mind on the sale of their horse prior to the advertising of it. Advertising refers to both on line, and verbally to her existing client base. If the customer acts within the cooling off period, then any expenses up to this point will be charged and paid for prior to the customer taking their horse.
